Terms of Service
DRAFT – pending attorney review. Version 2026-09-28-draft. This text has not been reviewed by a lawyer and may change before it takes effect.
1. Who we are
Counted Bankruptcy is software provided by Global Home Products Inc, doing business as Counted Legal (“we”, “us”). These Terms apply to the Counted Bankruptcy website and application (the “Service”).
2. Who may use the Service
The Service is only for (a) attorneys licensed to practice law and (b) staff of a law firm who work under the supervision of a licensed attorney, and for the clients those firms invite to the client portal. When you create a firm account you confirm that you are one of these. The Service is not for people preparing their own bankruptcy without an attorney.
3. Not legal advice; not a petition preparer
We are not a law firm and do not give legal advice. We are not a bankruptcy petition preparer under 11 U.S.C. § 110. The Service calculates and fills forms from the information you enter. The supervising attorney is responsible for reviewing every document and every number before anything is filed or given to a client.
4. Pilot
The Service is a pilot. Features may change or be removed, and there may be interruptions. During the pilot: electronic filing to the court is off; email and text messages are not sent (they stay in your firm’s outbox); credit bureau pulls return only a fictional sample report; and no remote AI service is used. Payments are not collected during the pilot. [Owner to decide: pilot end date and notice period before any charges.]
5. Your account
Keep your password, authenticator app and recovery codes private. Each person uses their own account. Two-step sign-in is required. Tell us promptly if you believe an account was accessed without permission. The firm’s attorney manages the firm’s users and can reset a user’s access.
6. Your firm’s data
Your firm owns the case data it enters and uploads. We process it only to provide the Service to your firm, as described in the Privacy Policy. You are responsible for having the right to enter your clients’ information and for your professional obligations of confidentiality. [Attorney to review: data-processing terms, confidentiality undertakings and any required client consent language.]
7. Acceptable use
Do not use the Service to break the law, to file documents you have not reviewed, to access another firm’s data, to test or bypass security, or to overload the Service.
8. Ending use
You may stop using the Service at any time and ask us to delete your firm’s data (see the Privacy Policy). We may suspend accounts that break these Terms or that put the Service or other firms at risk.
9. Disclaimers and limits
[Attorney to draft: warranty disclaimer, limitation of liability, indemnity and any caps, appropriate for a pilot offered to law firms.]
10. Governing law
[Attorney to confirm: Georgia law and venue.]
11. Changes
We will post changes on this page with a new version date. If a change is material, we will ask you to accept the new Terms when you next sign in.
